These Terms of Service (“Terms”) govern your access to and use of Peak State Navigator (the “Service”), operated by Peak State Global (“we”, “us”, or “our”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility and accounts
You must be at least 16 years old to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately of any unauthorised use. Access is often provided through an invitation from a coach; your use may be subject to that coaching arrangement.
2. Acceptable use
You agree not to:
- use the Service for any unlawful purpose or in violation of any applicable law;
- attempt to gain unauthorised access to the Service, other accounts, or its underlying systems;
- interfere with, disrupt, overload, or reverse-engineer any part of the Service;
- upload malicious code or content that infringes the rights of others.
3. Your content
You retain ownership of the content you create in the Service. You grant us a limited licence to host, store, process, and display your content solely for the purpose of operating and providing the Service to you and, where applicable, to your assigned coach. You are responsible for the content you submit and for ensuring you have the rights to do so.
4. Not professional advice
The Service is a personal planning and accountability tool. It does not provide medical, psychological, financial, legal, or other professional advice, and is not a substitute for consultation with a qualified professional. Any coaching content is for general informational and developmental purposes only. You are solely responsible for decisions you make based on your use of the Service.
5. Intellectual property
The Service, including its software, design, text, graphics, and trademarks, is owned by us or our licensors and is protected by intellectual property laws. These Terms do not grant you any right to use our branding without prior written permission.
6. Third-party services
The Service relies on third-party providers (such as hosting, authentication, and database services) and may link to third-party websites. We are not responsible for the content, policies, or practices of any third party.
7. Service availability
We aim to keep the Service available but do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue any part of the Service at any time, with or without notice. We may also perform maintenance that temporarily limits access.
8. Disclaimer of warranties
The Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will meet your requirements or that it will be secure, uninterrupted, or error-free.
9. Limitation of liability
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us, if any, in the twelve months preceding the claim. 13. Governing law
These Terms are governed by the laws of Australia, without regard to conflict-of-law principles. Any disputes will be subject to the exclusive jurisdiction of the courts of Australia.
